Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, commonly known as the General Data Protection Regulation (GDPR) (OJEU L 119/1, 04-05-2016), establishes a modernised and accountability-focused framework for data protection in Europe.
Article 12 of the GDPR, under the heading “Transparency of information, communication and procedures for exercising the data subject’s rights,” outlines the following in paragraph 1:
The controller shall take appropriate steps to provide the data subject with any information referred to in Articles 13 and 14, as well as any communication pursuant to Articles 15 to 22 and 34 concerning processing, in a concise, transparent, intelligible and easily accessible form, in clear and plain language, in particular any information specifically addressed to a child. The information shall be provided in writing or by other means, including, where appropriate, by electronic means. Where requested by the data subject, information may be provided orally, provided that the identity of the data subject is proved by other means.
To harmonise the increased demand for information introduced by the GDPR with clarity and understanding in presentation, Data Protection Authorities recommend adopting a multi-level information model.
The multi-level information approach involves:
- Presenting basic information at a first level, summarized simultaneously and in the same medium as the data collection.
- Referring to additional information on a second level, where the remaining details are provided in a more suitable medium for comprehension, presentation, and, if desired, archiving.
